Terms of Service

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Trainko (hereinafter referred to as "the App") regarding your use of the App and any premium membership services. By downloading, installing, using the App, or purchasing any subscription, you acknowledge that you have read, understood, and agreed to all terms of this agreement. If you do not agree with any of these terms, please stop using the App immediately.

2. Service Description

• The App provides AI Agents with visual, interactive daily workout plan displays and training execution recording capabilities.
• The App operates strictly on a "local-first" principle. Core functionalities run locally on your device without requiring reliance on external proprietary servers.
• The App communicates with your configured AI Agent via a built-in local HTTP service, through which your AI Agent creates and customizes training plans via standard APIs.
• The App offers both standard free features and premium Trainko Membership services. Basic features can be used without creating an account.
• The App does not guarantee the content, safety, or suitability of any training plan. All workout plans are generated by third-party AI Agents configured by you or manually created by yourself. The App serves solely as a visualization and logging platform and does not participate in the medical review or prescription of fitness routines.

3. AI Agent Generated Content & Hallucination Disclaimer

The App relies on third-party AI Agents configured by the user. Due to the inherent nature of AI technology, you acknowledge and agree that:

• Model Hallucinations & Limitations: AI models may produce hallucinations, context misinterpretations, or algorithmic biases, resulting in exercise routines with excessive training volume, unsafe loads, or insufficient recovery periods;
• User's Independent Safety Duty: You maintain primary responsibility for your own physical safety. You must review all exercises, target weights, sets, and reps generated by your AI Agent before execution. If any suggested workload exceeds your physical capacity, you must adjust or terminate the exercise immediately;
• Severance of Liability: The App developer disclaims all liability for injuries, including rhabdomyolysis, tendon tears, joint dislocations, or cardiovascular events resulting from following AI-generated workouts.

4. Trainko Membership & Auto-Renewable Subscriptions

When you choose to purchase a Trainko Membership (including Monthly and Annual plans), the following terms regarding Apple App Store Auto-Renewable Subscriptions shall apply:

4.1 Membership Benefits

With an active Trainko Membership, you enjoy access to premium capabilities, including but not limited to: seamless multi-device iCloud sync, standalone Apple Watch workout tracking with real-time heart rate monitoring, full training history access beyond the rolling 14-day limit, multi-gym equipment and weight preset management, and data import/export.

4.2 Subscription Plans & Pricing

• Monthly Subscription: Billed monthly on a recurring basis. The standard price is $1.99 / ¥12.00 per month (or promotional introductory price where eligible, renewing at regular rate thereafter);
• Annual Subscription: Billed annually on a recurring basis. The standard price is $14.99 / ¥98.00 per year.

Actual pricing is displayed in your local currency within the App via StoreKit. Payment will be charged directly to your Apple ID account upon purchase confirmation.

4.3 Free Trial Policy

Certain plans (such as the Annual plan) may include a free trial period (e.g., 7-day free trial) for eligible new subscribers:

• Free trial offers are strictly available to first-time subscribers of the subscription group and are limited to one per Apple ID;
• If you cancel at least 24 hours before the end of the free trial period, your account will not be charged;
• If you do not cancel at least 24 hours prior to expiration, your subscription will automatically renew into a paid annual subscription, and the annual fee will be charged to your Apple ID.

4.4 Auto-Renewal & Billing

• Subscriptions renew automatically. Unless auto-renew is turned off at least 24 hours before the end of the current billing cycle (or trial period), your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period;
• Upon successful charge, your membership benefits will be extended for another full subscription period.

4.5 Cancellation & Subscription Management

You can review, modify, or cancel your subscription at any time:

• Tap "Manage Subscriptions" at the bottom of the in-app Paywall to open the Apple subscription management sheet directly; or
• Go to your iOS device Settings → tap [Your Name / Apple ID] at the top → tap "Subscriptions" → select "Trainko" → tap "Cancel Subscription".

If canceled, your subscription remains active until the end of the current billing cycle, with no subsequent charges.

4.6 Upgrades and Downgrades

• Upgrade (Monthly to Annual): Upgrading takes effect immediately. A new 1-year annual billing cycle starts instantly, and any unused days remaining in your current monthly subscription will be refunded pro-rata by Apple automatically;
• Downgrade (Annual to Monthly): Downgrading is scheduled for the next renewal date. You retain full annual membership privileges until the end of your current annual period.

4.7 Refunds

All transactions and billing are handled exclusively by Apple App Store. The App developer does not process payments or issue direct refunds. To request a refund, please submit your request to Apple at reportaproblem.apple.com in accordance with Apple Media Services Terms and Conditions.

5. User Conduct & Network Security

When using the App, you agree to comply with applicable laws and the terms of this agreement. You shall not:

• Use the App or its local services for any unlawful, illegal, or rights-infringing activities;
• Network Exposure Warning: The App's built-in local HTTP server listens exclusively on the loopback interface (localhost). Port-forwarding, tunneling, or exposing this server to the public Internet is strictly prohibited; the developer assumes no liability for intercepted data resulting from unauthorized network exposure;
• Reverse-engineer, decompile, crack, maliciously exploit, or commercially reuse the App without prior written permission;
• Use the App to distribute spam, malicious code, or engage in disruptive activity.

6. Workout Share Cards & Social Media

• Workout summary cards and periodic progress graphics are rendered entirely on-device;
• If you choose to export or post these graphics to third-party social platforms, you acknowledge that you are voluntarily disclosing your personal workout data;
• You agree not to generate or share materials that violate laws, copyrights, or public decency.

7. Intellectual Property

All intellectual property rights in the App (including code, UI design, icons, illustrations, and copy) belong to the App developer. You are granted a limited, personal, revocable, non-commercial license to use the App.

8. Health & Medical Disclaimer

• Your personal data and health information are protected under the App's Privacy Policy;
• Exercise instructions, 1RM progression models, and AI-generated workout routines are provided solely for general informational and fitness reference purposes. They do not constitute medical diagnoses, physical therapy, or professional advice;
• Always consult a qualified healthcare provider or certified trainer before beginning any new training program, especially if you have pre-existing cardiovascular, musculoskeletal, or joint conditions.

9. Disclaimer & Limitation of Liability

• The App does not prescribe or endorse specific training routines. Workout designs, load choices, and movement selections are determined either by third-party AI Agents or by yourself. To the maximum extent permitted by applicable law, the developer shall not be liable for any physical injury, strain, or medical complications resulting from workouts;
• AI-generated recommendations may contain inaccuracies due to model constraints. Always exercise your own discretion;
• The developer is not liable for data loss or service interruption caused by force majeure, hardware malfunction, operating system updates, or Apple server downtime;
• To the maximum extent permitted by law, the developer's total cumulative liability for all claims arising from your use of the App shall not exceed the subscription fees actually paid by you to the App in the 12 months preceding the claim.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated versions will be published within the App and become effective upon publication. Continued use of the App following any changes indicates your acceptance of the updated terms.
